Background of Direct Access

Direct Access was originally implemented in California in 1998. At that time, residential, commercial and industrial customers were eligible to participate in the program. The market grew rapidly until September of 2001 when the CPUC suspended Direct Access due to events that led to rolling blackouts and high power costs. From September 2001 through April 2010, only customers who had entered the market between 1998 and 2001 were eligible for Direct Access. In October 2009 Governor Arnold Schwarzenegger signed into law Senate Bill 695 which allows for a limited reopening of Direct Access to non-residential customers starting in April 2010. Eligibility: To qualify for Direct Access with 3 Phases Renewables, you must either already be eligible for Direct Access or go through the application process with your utility.

Due to Senate Bill 695, , new non-residential customers are able to apply for Direct Access (DA) eligibility in California, starting in April 2010. 3 Phases will help customers with this process, contact us for details.

Under the reopening rules, new customers may enroll in DA up to a maximum allowable annual limit. Each investor owned utility (IOU) in California (PG&E, SCE and SDG&E) is permitted to increase their DA load up to these limits over the next four years.

The approximate annual increases permitted under the new cap are (percentages are provided based on the overall four year market capacity):

• Year 1 (2010): Up to 35% of the room available under the cap (the market cap for Year 1 has been met)
• Year 2 (2011): An additional 35% of the room available under the cap for a total of up to 70% of the room available (the market cap for Year 2 has been met)
• Year 3 (2012): An additional 20% of the room available under the cap for a total of up to 90 % of the room available under the cap (the market cap for Year 3 has been met)
• Year 4 (2013): An additional 10% of the room available under the cap for a total of up to 100% of the room available under the cap (the scheduled application date for year 4 is January 2012)

*Note that Direct Access is still regulated for Residential customers.

Index pricing allows for price transparency and the ability to quickly react to market price changes.

3. Hybrid Pricing: Combines the best of fixed and index pricing. Hybrid pricing is ideal for large businesses with low-to-medium tolerance for risk of price fluctuations or businesses who want more control over their rates.

Note: Due to regulation of Direct Access in California, 3 Phases Renewables (and other Energy Service Providers) cannot provide service to new residential customers. We can only accept customers who are currently entered into Direct Access, thereby making them eligible for the program.
